This Court and Magistrate Judge Moses have already determined that Plaintiff's claims are frivolous. [...] Nearly all of the motions in this matter contain the hallmarks of artificial intelligence ("AI") fabrication, including non-existent hallucinated cases, formatting unchanged from that produced by AI platforms, and remnants of prompts that the drafter declined to delete before filing before this Court. [...] Yet, there has been no change in their behavior. [...] The Court ORDERS LiveVideo and Constants to pay $85,056 in attorneys' fees and costs to Defendants within 21 days of this order.
LiveVideo.AI sued National Amusements, Shari Redstone and others for billions of dollars. The court and the magistrate judge had already found the claims frivolous, and its counsel had already been sanctioned 10,000 US dollars and referred to the grievance committee for filing dozens of baseless motions. The filings kept coming, and kept carrying hallucinated cases along with formatting straight out of an AI platform and pieces of the prompts left in the text. The opposition to the sanctions motion itself appears to have been drafted the same way, with more citations that do not exist. On 9 June 2026 Judge Ho awarded 85,056 US dollars in fees and referred counsel to the grievance committee a second time. It is the largest fee award for fabricated citations on this page after the Oregon penalty, and the whole of what separates it from the smaller ones is that the first sanction changed nothing.
